Terms of Service

The Service

My Summit Chatbot lets you build, train, and publish chatbots for your website, collect leads, and connect to other tools. We may add, change, or remove features over time.

Your account

• You must be at least 18 and able to enter into a contract.
• Provide accurate information and keep it up to date.
• Keep your login details safe. You are responsible for activity under your account.
• Tell us right away if you believe your account has been accessed without permission.

Plans, billing, and cancellation

• Paid plans are billed in advance on a recurring basis at the price shown when you subscribe.
• Your plan renews automatically until you cancel.
• You can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Except where the law requires otherwise, payments already made are not refundable.
• We may change prices with advance notice. Changes apply from your next billing period.

Your content and your chatbots

You own the content you add to the Service, including your website content, instructions, and the leads your chatbots collect. You give us permission to host, process, and display that content only as needed to run the Service for you. You are responsible for your content, for what your chatbots say to your visitors, and for making sure you have the rights and permissions needed to use that content and to collect information from your visitors, including providing your own privacy notice where required.

Acceptable use

You agree not to:

• Use the Service for anything unlawful, harmful, deceptive, or abusive.
• Send spam, or collect personal information without proper notice and permission.
• Upload content that infringes someone else's rights.
• Attempt to break, overload, probe, or gain unauthorized access to the Service.
• Copy, resell, or reverse engineer the Service, except as your plan allows.

AI-generated responses

Chatbot answers are generated by AI and may sometimes be inaccurate, incomplete, or out of date. You are responsible for reviewing how your chatbot responds and for how you and your visitors rely on it. AI responses are not professional advice.

Third-party services

The Service works with third-party tools such as AI model providers, Zapier, Make, and Google Sheets. Your use of those tools is governed by their own terms. If you connect your own API key, you are responsible for the charges and terms of that provider.

Agencies and client accounts

If you use the Service for your clients, you are responsible for your clients' use of the Service and for making sure they follow these Terms.

Our intellectual property

The Service, including its software, design, and branding, belongs to us or our licensors. These Terms do not give you any rights to it other than the right to use the Service as described here.

Suspension and termination

You may stop using the Service at any time. We may suspend or end your access if you break these Terms, do not pay amounts due, or use the Service in a way that could cause harm. Where reasonable, we will give you notice first.

Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the Service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim arose.

Indemnity

You agree to defend and hold us harmless from claims and costs arising from your content, your chatbots, or your breach of these Terms.

Changes to these Terms

We may update these Terms from time to time. We will post the new version here and change the "Last updated" date. If you keep using the Service after the changes take effect, you accept the updated Terms.

Governing law

These Terms are governed by the laws of the United States and of the state where My Summit Chatbot is established, without regard to conflict-of-law rules.
